Any reference to “you” or “your”, means you as a customer of our goods and/or as a user of our websites. Any reference to “we”, “us”, “our” or “Power Plate” is to Power Plate Gulf LLC FZ and Power Plate India PVT. LTD. (“PPG” / “PPI”)

By accessing and continuing to use the websites, you agree to be legally bound by these terms of use. Please note that we may update and amend these terms of use from time to time and any changes will be posted on the websites. However, it is your responsibility to ensure you review these terms of use regularly to familiarize yourself with any changes.

You may be asked to agree to further terms and conditions when using specific parts of our websites, for example purchasing goods via the websites. (TIN 103000805346) with our registered office at Emirates Towers, Sheikh Zayed Road, PO Box 31303, Dubai, U.A.E. and Power Plate India PVT. LTD., a company registered in India, under company nr. U36999MH2021PTC355202, TAN nr. MUMP44160E and PAN nr. AALCP8028M, with our registered office at Bandra Kurla Complex, Vibgyor Towers, G Block, Level 8, C62, Bandra East, Mumbai 400098, India.
ACCESSING OUR WEBSITES AND AVAILABILITY
Access to our websites is permitted on a temporary basis, and we reserve the right to withdraw or amend the services we provide on our websites without notice (see below). We will not be liable if for any reason our websites is unavailable at any time or for any period. From time to time, we may restrict access to some parts of our websites, or our entire websites, to users who have registered with us.
While we endeavour to ensure that the websites are normally available 24 hours a day, we cannot promise that our websites will be free from errors or omissions or that it will be available uninterrupted and in a fully operating condition. The websites may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond our control. We will not be liable to you or to any other person in the event that all or any part of the websites is discontinued, modified or changed in any way.

SUBSCRIBING / REGISTERING WITH US

You accept that you are able to stop using the websites at any time and at your sole discretion. We reserve the right to suspend, restrict or terminate your access to the Websites or any part of it at any time at our sole discretion.
We may also ban or suspend you as a user of the websites if you do not comply with these terms of use and, in such an event, your permission to use these websites shall terminate and you must immediately destroy any downloaded or printed extracts from the websites.
LICENCE
You grant to us a worldwide, royalty-free, irrevocable, non-exclusive licence (including the right to sub-license) to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform or display any content (in whole or part) you upload, post or email and/or to incorporate such content in other works in any form, media or technology now known or developed.
COMPENSATION
You agree to compensate us (including our affiliates, employees, officers, agents or partners) and hold us harmless from and against any direct or indirect loss or damage we suffer arising from any third party claim in relation to any content you upload, post or email on or through our websites, your use of our websites, or your breach of the provisions of these terms of use.
SANCTIONS

On being made aware of any such breaches, we may ban, delete or prohibit any content that relates to those breaches or that we judge harmful to individuals or the rights of Power Plate Gulf and/or Power Plate India or any of our affiliates, licensors or partners. We reserve the right to take whatever action we deem necessary to prevent such breaches including issuing warnings or banning you from our websites generally.
In addition, we may at any time move, modify or remove any content or take further legal action as a result of breaches or suspected breaches of our terms of use, any applicable laws or regulations, or where our rights or third party rights are threatened or infringed.
INTELLECTUAL PROPERTY RIGHTS
Performance Health Systems (PHS) is the owner of all copyrights and other intellectual property rights in our websites and in the material published on it. Those works are protected by intellectual property laws and treaties around the world. All such rights are reserved.

VIRUSES, HACKING AND OTHER OFFENCES
You must not misuse our websites by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to our websites, the server on which our websites is stored, or any server, computer or database connected to our websites. You must not attack our websites via a denial-of-service attack or a distributed denial-of-service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities, and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our websites will cease immediately.

LAW AND JURISDICTION
These terms are governed by UAE and Indian law and you can bring legal proceedings in respect of our websites or goods in the above courts. If you live in the GCC you can bring legal proceedings in the Dubai court. If you live in India you can bring legal proceedings in the Mumbai court.
VARIATIONS
We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our websites.
